This month I would like to touch on a favorite topic for so many – of our furry little friends – Pets! What are the Condo rules governing them?
To be very clear, condo corporations do have the authority to limit pets in condominiums. For this to happen however, it must be a part of the declaration, a rule or regulation by way of the initial condo declaration or it must have been voted in after. Also, it should be noted that for rules or by-laws passed after the initial declaration was established, a grandfather clause would be included for those with existing pet owners – they would not be expected to remove their pets from the premises.
Rules and regulations are specific enough to include information about the type of animal specifically permitted and the number and weight/size of the pet. Generally, in my experience I have noticed pets under 30lbs are often permitted, and there usually is a limit of 2 pets per unit. Anything over 30lbs and more than 2 pets can be cause for concern and should be checked prior to making any purchasing decisions.
For those that are looking to purchase a condo and you are already a pet owner, it is especially important to understand and read the condo declaration and rules relating to pets before making an offer. It’s also key to understand that claiming ignorance of the rules and regulations won’t relieve you of any issues or repremendaning you may get. Always check in with your realtor for the right advice as rules change from condo to condo.
